Property damage does not always require destruction of substance. Defacement can suffice where restoration requires effort. Scope, duration and cleaning cost matter.

Elements of section 125 StGB

Section 125 StGB punishes destroying, damaging, defacing or rendering unusable another person's property. The basic penalty range is imprisonment up to six months or a fine of up to 360 daily rates.

In practice cases range from scratched cars to broken windows and graffiti. The key question is whether value, usability or appearance was legally relevantly impaired.

Intent, evidence and distinction

Section 125 StGB is an intentional offence. A mere accident is not automatically criminal property damage. The distinction between intent, conditional intent and negligence is often central.

From a legal perspective videos, witnesses, alcohol or conflict context and the timeline should be secured early.

Aggravated property damage under section 126 StGB

Section 126 StGB increases the penalty range for certain protected items and for damage exceeding 5,000 euros. The precise amount of damage is therefore not only a civil-law question.

Especially with older items or inflated repair estimates, critical review is worthwhile. The criminally relevant damage must be evidenced.

Restitution, diversion and sentencing

In property damage cases quick and well documented restitution is often decisive. It can enable diversion or at least mitigate sentence.

Nevertheless the defence should not rush into an admission. First assess the file and evidence, then align restitution and procedural objective.

Do not accept the damage figure unchecked. In property damage cases the amount affects aggravation, diversion and sentencing. Invoices and estimates should be reviewed carefully.
